  8. This lease is made between {LESSOR_NAME_ADDR}. {OWNER(S)} of the 
  9. leased premises, hereinafter referred to as LESSOR, and 
  10. {LESSEE_NAME_ADDR}, hereinafter referred to as LESSEE, for the 
  11. purpose of arranging for the lease of the following property for 
  12. farming and livestock grazing purposes:

  21. LESSOR also grants to LESSEE the right to use the leased premises 
  22. for hunting, fishing and other recreational activities including 
  23. the exclusive authority to sub-let the premises for those purposes.

  25. The lease is subject to the following terms and conditions:
  26.

  28. LESSOR hereby reserves the exclusive right to use the leased 
  29. premises for hunting, fishing and other recreational activities 
  30. including the exclusive authority to sub-let the premises for 
  31. those purposes.

  33. The lease is subject to the following terms and conditions:
  34.  
  35. .TX5 *** TERM OF LEASE, RENT AND PAYMENT ************************
  36. {!P}.  TERM OF LEASE.  The term of this lease shall be for 
  37. {LEASE_TERM}, beginning {START_DATE} and terminating {END_DATE} 
  38. with an option for LESSEE to renew the lease for an additional 
  39. five-year term at a rental based on the market value of the 
  40. leased premises at that time.  LESSEE agrees that he will possess 
  41. and occupy the ranch continuously during the term of the lease 
  42. and surrender possession and occupancy of the premises peaceably 
  43. to LESSOR or to his successor lessee(s) at the termination of 
  44. the lease, with  the exception of unharvested crops, if any, which 
  45. shall continue in lessee's possession and control until harvested 
  46. but in no event later than July 1 of the year of termination of 
  47. the lease.

  49. LESSEE shall notify LESSOR on or before {RENEW_DEADLINE} whether 
  50. it is his intention to exercise his option to renew the lease for 
  51. another term or to yield possession of the ranch to LESSOR at 
  52. the conclusion of the current term.
  53.  
  54. {!P}.  RENT.  Lessor agrees to pay, as consideration for the 
  55. lease, the sum of {RENT_AMOUNT} per {RENT_PERIOD}, payable as 
  56. follows:

  60. .TX6 *** RIGHT OF ENTRY & SURFACE DAMAGES, RESERVATION OF *******
  61. {!P}.  RIGHT TO ENTRY.  LESSOR reserves the right of him, his 
  62. lessees, assigns or guests to enter the ranch at reasonable times 
  63. for the following purposes:
  64.  
  65.      (a) for consultation with LESSEE,
  66.  
  67.      (b) for making repairs, improvements and inspections,
  68.  
  69.      (c) for developing mineral resources,
  70.  
  71.      (d) for caring for acreage of the ranch not included in the
  72.          lease such as CRP acreage, and
  73.  
  74.      (e), after notice of termination, for customary seasonal 
  75.           work required for the proposed change of possession.
  76.  
  77. It is agreed that any such entry on the leased premises shall not 
  78. interfere unreasonably with the LESSEE in carrying out his regular 
  79. ranching operations.
  80.  
  81. {!P}.  SURFACE DAMAGES.   LESSOR reserves all rights to any 
  82. damages or other compensation which shall be or become due the 
  83. surface owner or tenant for damages to vegetation trees, fences, 
  84. buildings, roadways or other improvements (other than crops 
  85. belonging solely to LESSEE, including grass seed  crops) and for 
  86. damages to their share of any crops on the leased premises which 
  87. may result from operations of any other lessee of the premises, 
  88. the operations of any lessee of mineral interests therein, or the 
  89. actions of any other person.
  90.  
  91. .TX7 *** ASSIGNMENT BY LESSEE NOT PERMITTED WITHOUT CONSENT *****
  92. {!P}.  NO RIGHT TO ASSIGN.  The LESSOR does not convey to the 
  93. LESSEE the  right to assign this lease to any person or persons 
  94. without their express written consent.
  95.  
  96. .TX8 ** TERMINATION ON SALE & LESSEE'S RIGHT OF FIRST REFUSAL ***
  97. {!P}.  TERMINATION ON SALE WITH FIRST RIGHT OF REFUSAL.  If the LESSOR, 
  98. his  heirs  or assigns, desire to sell  or  otherwise  transfer 
  99. title  to  the ranch during the term of this  lease  then  LESSEE 
  100. shall have the right to purchase the ranch for the same price for 
  101. which LESSOR is willing to sell to any other person.  If within 
  102. fifteen  (15)  days after notice in writing from the  LESSOR  to 
  103. LESSEE  of his intent to sell at a specified price, the  LESSEE 
  104. fails  to  exercise his option to buy, then in that  event,  this 
  105. lease shall be subject to termination by the ranch owner on  not 
  106. less than ninety (90) days notice to LESSEE following acquisition 
  107. of title.  If the lease is not terminated during such ninety (90) 
  108. day period by the purchaser, or purchasers, such sale shall be  
  109. subject to the terms of this lease which shall be binding on both 
  110. the LESSEE and the new ranch owner.

  112. .TX9 *** HEIRS, SUCCESSORS & ASSIGNS, BINDING ON ****************
  113. {!P}.   HEIRS  AND  SUCCESSORS.   The terms of this lease  shall  be 
  114. binding upon the heirs, executors, administrators, and successors 
  115. of  both  LESSORS and LESSEE in like manner as upon the  original 
  116. parties.
